Security Deposit Rules (2026)

Maximum Allowed:

2 months' rent for unfurnished; 3 months' rent for furnished units

Interest Requirements:

Must accrue interest at bank passbook rate (currently ~0.01%). Annual accounting required.

Return Timeline:

21 days from move-out with itemized deductions. Electronic payment acceptable.

Prohibited Deductions:

Normal wear and tear, painting, carpeting replacement (after 3 years), cleaning in move-in condition

Just-Cause Eviction (AB 1482)

Valid Causes for Eviction:

  • Non-payment of rent (after 3-day notice & cure period)
  • Lease violations (after notice & opportunity to cure)
  • Nuisance or damage to property

  • Working locks on doors and windows

  • Lead-free paint (pre-1978 homes)
  • Protection from pests (new for 2026)

Tenant Right-to-Repair (2026)

Repair Timelines:

Emergency repairs: 24 hours. Urgent repairs: 72 hours. Non-urgent: 14 days from notice.

Tenant Remedies:

Tenants may hire repairs if landlord fails to respond, and deduct cost from rent (up to 1 month's rent).

Access Requirements:

Must provide 24-hour notice before entry except emergencies. Entry limited to reasonable hours.

Anti-Retaliation (Enhanced 2026)

Protected Activities (365-day protection):

  • Requesting habitability repairs
  • Contacting housing authorities
  • Joining tenant organizations
  • Objecting to rent increases (if unjustified)
  • Exercising legal rights (new protections 2026)

Presumed Retaliatory Acts:

Raising rent, decreasing services, or threatening eviction within 365 days of protected action = presumed retaliation unless landlord proves otherwise.
